MboaSon — Terms of Service

1. Purpose

MboaSon is a service published by [name of the structure/legal entity — TO BE COMPLETED], allowing a user to generate, via artificial intelligence, a personalized song (title, lyrics, and audio file) intended for a personal event (birthday, wedding, baptism, dowry, success, tribute, or any freely chosen occasion).

The use of the service implies full and unconditional acceptance of these terms.

2. Service Operation

The user provides an occasion, one or more first names, a desired tone, a musical style, and, optionally, an anecdote or message. These elements are transmitted to third-party artificial intelligence systems to generate a title, lyrics, and then an audio file.

The result is generated automatically. MboaSon does not guarantee that it will exactly match the user's expectations, as it is an AI-generated content based on inherently limited instructions.

3. Payment

The current rates are those displayed on the site at the time of the order, expressed in CFA Francs (XAF). Payment is made via Mobile Money (MTN Mobile Money, Orange Money) or by credit card, through our payment provider.

The paid content (lyrics and/or audio, depending on the chosen tier) is generated after payment confirmation. MboaSon neither directly stores nor processes payment data (card number, mobile money PIN) — these are exclusively managed by the payment provider.

4. Refund Policy[TO COMPLETE / VALIDATE]

Base proposal, to be adjusted according to your actual policy:

If the generation fails technically (no content delivered after confirmed payment), the user is entitled to a free retry or a full refund.
If the delivered content does not match the parameters requested by the user (wrong occasion, wrong style), a regeneration is offered within the limit of the chosen tier's quota (see pricing grid).
No refund is granted solely on the grounds of a subjective aesthetic preference on a content properly generated according to the provided parameters, the service being by nature an automatically generated creative content.

5. Ownership and Use of Generated Content

The user who paid for a song can listen to, download, and freely share it for personal purposes (social networks, WhatsApp, private events).

⚠️ [TO VERIFY] — The commercial use of the generated content (advertising, sale, integration into a third-party commercial project, use by a company) is not guaranteed by these terms until the terms of service of the underlying audio generation provider have been formally verified by MboaSon. When in doubt, the use of the generated content must be considered limited to personal and non-commercial use, until clarified.

MboaSon reserves the right to use the eight sample songs from its catalog (public demonstrations of the service) for product presentation purposes.

6. Prohibited Content

The user agrees not to provide information (first names, anecdotes, messages) that is hateful, defamatory, sexual, threatening, or intended to harass or harm a third party. MboaSon applies automatic moderation before any generation and reserves the right to refuse or interrupt an order whose content is deemed inappropriate, without refund if the attempt to bypass is obvious.

Orders concerning a minor remain subject to the same content rules; certain features (notably any vocal mechanism involving the recording of a human voice, should it be offered) are strictly excluded for any minor, without exception.

7. Liability

MboaSon makes every effort to ensure the availability of the service, without guaranteeing absolute continuity (maintenance, failure of a third-party provider — hosting, AI generation, payment).

MboaSon cannot be held responsible for the use of the content generated by the user that would infringe upon the rights of a third party (for example, using a person's name or information without their consent).

8. Modification of Terms

MboaSon may modify these terms at any time. The version in force at the time of the order is the one that applies.

9. Applicable Law[TO VERIFY]

These terms are governed by Cameroonian law. Any dispute falls within the jurisdiction of Cameroonian courts, subject to applicable public order provisions.
